Terms & Conditions

• ParkVahan refers to the technology platform that facilitates parking bookings and management.
• AmbuGrid System LLP refers to the Limited Liability Partnership that develops, owns, and operates the ParkVahan platform.
• Customer refers to a user who books a parking space through the application.
• Parking Owner refers to an individual or organization that manages one or more parking locations on ParkVahan.
• Guard refers to an authorized person assigned by the Parking Owner to manage vehicle entry and exit.
• Booking refers to a confirmed parking reservation made through the application.

To use ParkVahan, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher.
• Be legally eligible to enter into a binding agreement.
• Provide accurate and up-to-date information during registration.
• Verify your mobile number using OTP.
• Use only vehicles that you own or are authorized to use.

ParkVahan reserves the right to suspend or terminate accounts containing false, misleading, or fraudulent information.

You are responsible for:

• Maintaining the confidentiality of your account.
• Securing access to your registered mobile number.
• Keeping your profile and vehicle details updated.
• All activities carried out using your account.

Users must not share their accounts or allow unauthorized access.

• Parking bookings are subject to slot availability.
• Same-day advance booking is supported, subject to availability.
• A booking is confirmed only after successful payment.
• The application displays available parking capacity but does not assign a specific parking slot.
• Parking guards will allocate an available slot upon arrival.
• Bookings are valid only for the registered vehicle and are non-transferable, and may not be sold, rented, or made available to any third party.

Customers must present and scan the booking QR Code at both entry and exit of the parking location. Entry and exit are permitted only after successful QR verification or authorized manual verification by the assigned guard in exceptional cases. If the QR Code cannot be accessed due to technical issues, the assigned guard may manually verify the booking before allowing entry or exit. ParkVahan reserves the right to deny entry or exit if the booking cannot be verified.

Customers may extend their parking duration before the booked time expires, subject to availability and the parking location's policy. Additional parking charges will apply for the extended duration.

Customers may arrive at any time during their booked parking duration. Late arrival does not extend the booked parking period or reduce applicable parking charges.

If a vehicle remains parked beyond the booked duration:

• Applicable overstay charges will be calculated automatically according to the parking location's policy.
• All outstanding parking charges and penalties must be paid before the vehicle exits the parking premises.
• Repeated overstays or misuse of the service may result in suspension of booking privileges.

A vehicle left without any exit activity for 30 days or more may be treated as unclaimed. In such cases, the Parking Owner will notify the Customer and allow a reasonable period to retrieve the vehicle, except in safety or emergency situations. Removal, towing, or storage will be carried out in accordance with applicable local law, including police or authority involvement where required. Reasonable towing and storage charges will be borne by the Customer, and the Parking Owner will document the notice and action taken.

Customers may cancel a booking before the parking session begins. Where a customer cancels a confirmed booking, the amount paid for that booking is treated as a cancellation charge in full and is retained by ParkVahan. Convenience fees, taxes, and payment processing charges, where applicable, are treated in the same manner.

• All payments are processed through our authorized third-party payment gateway partner.
• A booking is confirmed only after successful payment.
• If payment fails, the booking will not be created.
• If payment is deducted but the booking is not confirmed, any refund or reversal shall be subject to the payment gateway and banking partner's processing timelines.
• Payouts to Parking Owners are subject to applicable tax deduction at source (TDS) under the Income Tax Act, 1961, based on the PAN details provided during onboarding, as described in the ParkVahan Privacy Policy.
• Payments for parking bookings relate to real-world, location-based parking services rendered at a physical location, and are processed through a third-party payment gateway outside of any app store's in-app billing system.

For Parking Owners, the total parking collections for a given day shall be settled according to ParkVahan's settlement process. Unless otherwise agreed, the previous day's collection will be settled on the following business day after applicable verification and adjustments.

Customers agree to:

• Park only in the slot assigned by the parking guard.
• Follow all parking instructions and safety guidelines.
• Keep their vehicle locked and secure.
• Ensure the registered vehicle matches the booking details.
• Comply with all applicable traffic and parking laws.
• Use only the designated parking space assigned by the parking guard.
• Use the parking premises only for parking their registered vehicle, and not for any commercial purpose.
• Follow all entry and exit verification procedures, including mandatory QR Code scanning.

Customers must not:

• Use another person's booking or QR Code.
• Sell, rent, transfer, or otherwise make a booking available to a third party.
• Attempt fraudulent bookings or payments.
• Damage parking property or equipment.
• Misuse the application or interfere with its operation.
• Use or access any area of the property other than the designated parking space without authorization.

Parking Owners are responsible for:

• Providing accurate parking information.
• Maintaining the parking premises.
• Ensuring safe and orderly parking operations.
• Assigning authorized guards.
• Keeping parking capacity information reasonably accurate.
• Ensuring CCTV cameras covering the parking area remain operational 24 hours a day, 7 days a week.
• Ensuring at least one authorized parking guard is present at the parking location during its operating hours to manage vehicle entry, exit, and parking operations.
• Completing the business verification (KYC) process, including providing PAN and other requested documents, before receiving payouts.

Parking Owners operate independently and are solely responsible for the condition, maintenance, security, surveillance, and day-to-day operation of their parking facilities. ParkVahan acts only as a technology platform and shall not be responsible for the operational management of any parking location.

Authorized guards shall:

• Verify customer bookings.
• Scan QR Codes or perform manual verification when necessary.
• Allocate parking slots.
• Record vehicle entry and exit.
• Report suspicious or unauthorized activities.

Customers are advised to:

• Lock their vehicles.
• Remove valuable belongings.
• Ensure the vehicle is parked safely.

Customers may use only the designated parking space assigned to them.

ParkVahan operates the technology platform; the parking facility, security, and vehicle handling are independently managed by the respective Parking Owner. No care, custody, or control of a Customer's vehicle or its contents is assumed by ParkVahan or AmbuGrid System LLP at any time. Responsibility for loss, theft, or damage to vehicles or personal belongings within parking premises rests with the respective Parking Owner, subject to applicable law.

Users shall not:

• Share OTPs or account credentials.
• Provide false identity or vehicle information.
• Provide false business verification information.
• Attempt unauthorized access to the platform.
• Manipulate bookings or payments.
• Use the platform for unlawful purposes.
• Abuse, threaten, harass, or intimidate parking staff or other users.

Violation may result in immediate suspension or permanent termination of the account.

The ParkVahan application, including its name, logo, design, software, source code, graphics, and all other content (excluding user-submitted information), is the exclusive property of AmbuGrid System LLP and is protected under applicable intellectual property laws.

Subject to your compliance with these Terms, AmbuGrid System LLP grants you a limited, non-exclusive, non-transferable, revocable license to download and use the ParkVahan application on a device that you own or control, solely for your personal, non-commercial use, and solely in accordance with the usage rules of the applicable app store.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the ParkVahan application or its content, except as expressly permitted by applicable law or with our prior written consent.

You may delete your ParkVahan account at any time through Settings → Account → Delete Account within the app, in accordance with the process described in the ParkVahan Privacy Policy. Certain records, including PAN and payout-linked tax records, may be retained after deletion where required under the Income Tax Act, 1961 or other applicable law, as described in the Privacy Policy.

Provisions of these Terms that by their nature should survive account deletion or termination (including Intellectual Property, Indemnity, Limitation of Liability, and Governing Law) shall continue to apply.

ParkVahan reserves the right to suspend or terminate any account without prior notice if it is involved in fraudulent activity, repeated policy violations, misuse of QR verification, abuse of platform features, or any activity that affects platform security or operations.

Users agree to indemnify and hold harmless ParkVahan, AmbuGrid System LLP, its directors, employees, partners, affiliates, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from misuse of the platform, violation of these Terms, or unlawful activities.

ParkVahan shall not be liable for any failure or delay in providing services due to events beyond its reasonable control, including natural disasters, government actions, strikes, internet outages, power failures, pandemics, or other force majeure events.

ParkVahan integrates with third-party service providers to operate the platform, including a database and cloud storage provider; a payment gateway provider; SMS/OTP and push notification providers; a vehicle-verification service provider; an email service provider; a mapping service provider; and cloud hosting and infrastructure providers. These providers may store account, booking, vehicle, payment, photo, and document records and support booking payments, refunds, settlements, notifications, verification emails, location search, and backend systems.

Third-party providers operate under their own applicable terms and privacy policies. ParkVahan shall not be responsible for interruptions, delays, unavailability, or failures caused by third-party services, subject to applicable law.

ParkVahan is a technology platform that facilitates booking, payment, and communication between Customers and Parking Owners, and is not responsible for the operation or security of any parking facility. To the maximum extent permitted by law, ParkVahan shall not be liable for:

• Vehicle theft or damage.
• Loss of personal belongings.
• Delays caused by traffic or unforeseen events.
• Service interruptions due to technical or third-party failures.
• Acts or omissions of independent Parking Owners or their staff.

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law, including liability for fraud, wilful misconduct, gross negligence, or any statutory consumer right that cannot lawfully be excluded. Subject to the foregoing, ParkVahan's total liability shall not exceed the amount paid by the user for the booking giving rise to the claim, to the maximum extent permitted by applicable law.

Your use of ParkVahan is also governed by the ParkVahan Privacy Policy, which explains how AmbuGrid System LLP collects, uses, stores, shares, protects and retains personal data in connection with the Platform.

By using ParkVahan, you acknowledge and agree to the processing of your personal data in accordance with the Privacy Policy and applicable data protection laws. The Privacy Policy is available through the ParkVahan application and website. Certain personal data and records may be retained after account deletion where required or permitted by applicable law.

This section applies in addition to the other provisions of these Terms if you download or use the App through the Apple App Store or Google Play Store.

A. Apple App Store Users: This Agreement is between you and AmbuGrid System LLP only, and not with Apple Inc. ("Apple"). AmbuGrid System LLP, not Apple, is solely responsible for the App and its content. The license granted is limited to a non-transferable license to use the App on an Apple-branded device that you own or control. Apple has no obligation to furnish maintenance or support services. AmbuGrid System LLP, not Apple, is responsible for claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. You must comply with applicable third-party terms, and Apple and its subsidiaries are third-party beneficiaries of these Terms.

B. Google Play Users: Your use of the App through Google Play is also subject to the Google Play Terms of Service. Payments for parking bookings and related services relate to real-world, location-based parking services and are processed through a third-party payment gateway outside Google Play’s in-app billing system, in accordance with Google Play’s Payments Policy. Nothing in this section limits rights under applicable consumer protection law.

ParkVahan reserves the right to update or modify these Terms at any time, including as new features are introduced in future releases. Updated Terms become effective immediately upon publication within the application. Continued use of the platform after such updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of India.

The parties shall first attempt to resolve any dispute amicably. If the dispute remains unresolved, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. Subject to the arbitration proceedings, the competent courts where ParkVahan’s registered office is located shall have exclusive jurisdiction. Nothing in this arbitration provision shall prevent either party from seeking relief in a small claims court of competent jurisdiction for disputes within that court’s jurisdiction.

• Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms, together with the ParkVahan Privacy Policy, constitute the entire agreement between you and AmbuGrid System LLP regarding your use of the App, and supersede any prior agreements or understandings.
• No Waiver: No failure or delay by ParkVahan or AmbuGrid System LLP in exercising any right under these Terms shall operate as a waiver of that right.
• Assignment: You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. AmbuGrid System LLP may assign these Terms without restriction.

Complaint Procedure: Complaints may be submitted by email to the Grievance Officer at the address above, specifying the nature of the complaint and relevant booking or account details. Complaints will be acknowledged within 48 hours of receipt and redressed within one month from the date of receipt, in accordance with applicable law.
