1. Definitions

• ParkVahan refers to the technology platform that facilitates parking bookings and management.
• Customer refers to a user who books a parking space through the application.
• Parking Owner refers to an individual or organization that manages one or more parking locations on ParkVahan.
• Guard refers to an authorized person assigned by the Parking Owner to manage vehicle entry and exit.
• Booking refers to a confirmed parking reservation made through the application.

2. User Eligibility

To use ParkVahan, you must:

• Be legally eligible to enter into a binding agreement.
• Provide accurate and up-to-date information during registration.
• Verify your mobile number using OTP.
• Use only vehicles that you own or are authorized to use.

ParkVahan reserves the right to suspend or terminate accounts containing false, misleading, or fraudulent information.

3. User Account

You are responsible for:

• Maintaining the confidentiality of your account.
• Securing access to your registered mobile number.
• Keeping your profile and vehicle details updated.
• All activities carried out using your account.

Users must not share their accounts or allow unauthorized access.

4. Booking Policy

• Parking bookings are subject to slot availability.
• Same-day advance booking is supported, subject to availability.
• A booking is confirmed only after successful payment.
• The application displays available parking capacity but does not assign a specific parking slot.
• Parking guards will allocate an available slot upon arrival.
• Bookings are valid only for the registered vehicle and are non-transferable.

5. Entry and Exit

Customers must present and scan the booking QR Code at both entry and exit of the parking location. Entry and exit are permitted only after successful QR verification or authorized manual verification by the assigned guard in exceptional cases. If the QR Code cannot be accessed due to technical issues, the assigned guard may manually verify the booking before allowing entry or exit. ParkVahan reserves the right to deny entry or exit if the booking cannot be verified.

6. Booking Extension

Customers may extend their parking duration before the booked time expires, subject to availability and the parking location's policy. Additional parking charges will apply for the extended duration.

7. Late Arrival

Customers may arrive at any time during their booked parking duration. Late arrival does not extend the booked parking period or reduce applicable parking charges.

8. Overstay Policy

If a vehicle remains parked beyond the booked duration:

• Applicable overstay charges will be calculated automatically according to the parking location's policy.
• All outstanding parking charges and penalties must be paid before the vehicle exits the parking premises.
• Repeated overstays or misuse of the service may result in suspension of booking privileges.

9. Cancellation Policy

Customers may cancel a booking before the parking session begins. However:

• No refund will be provided for cancelled bookings.
• Convenience fees, taxes, or payment processing charges, if any, are non-refundable.

10. Payments

• All payments are processed through authorized third-party payment gateways.
• A booking is confirmed only after successful payment.
• If payment fails, the booking will not be created.
• If payment is deducted but the booking is not confirmed, any refund or reversal shall be subject to the payment gateway and banking partner's processing timelines.

For Parking Owners, the total parking collections for a given day shall be settled according to ParkVahan's settlement process. Unless otherwise agreed, the previous day's collection will be settled on the following business day after applicable verification and adjustments.

11. Customer Responsibilities

Customers agree to:

• Park only in the slot assigned by the parking guard.
• Follow all parking instructions and safety guidelines.
• Keep their vehicle locked and secure.
• Ensure the registered vehicle matches the booking details.
• Comply with all applicable traffic and parking laws.
• Use only the designated parking space assigned by the parking guard.
• Use the parking premises only for parking their registered vehicle.
• Follow all entry and exit verification procedures, including mandatory QR Code scanning.

Customers must not:

• Use another person's booking or QR Code.
• Attempt fraudulent bookings or payments.
• Damage parking property or equipment.
• Misuse the application or interfere with its operation.
• Use or access any area of the property other than the designated parking space without authorization.

12. Parking Owner Responsibilities

Parking Owners are responsible for:

• Providing accurate parking information.
• Maintaining the parking premises.
• Ensuring safe and orderly parking operations.
• Assigning authorized guards.
• Keeping parking capacity information reasonably accurate.
• Ensuring CCTV cameras covering the parking area remain operational 24 hours a day, 7 days a week.
• Ensuring at least one authorized parking guard is present at the parking location during its operating hours to manage vehicle entry, exit, and parking operations.

Parking Owners operate independently and are solely responsible for the condition, maintenance, security, surveillance, and day-to-day operation of their parking facilities. ParkVahan acts only as a technology platform and shall not be responsible for the operational management of any parking location.

13. Guard Responsibilities

Authorized guards shall:

• Verify customer bookings.
• Scan QR Codes or perform manual verification when necessary.
• Allocate parking slots.
• Record vehicle entry and exit.
• Report suspicious or unauthorized activities.

14. Vehicle Safety

Customers are advised to:

• Lock their vehicles.
• Remove valuable belongings.
• Ensure the vehicle is parked safely.

Customers are permitted to use only the designated parking space assigned for their booking. Access to or use of any other part of the property is not permitted unless expressly authorized by the Parking Owner.

While Parking Owners are responsible for maintaining appropriate security measures, including CCTV surveillance, ParkVahan shall not be responsible for any loss, theft, damage to vehicles, damage to personal belongings, or any other loss occurring within the parking premises. Such matters shall remain subject to applicable law and the responsibility of the respective Parking Owner, where applicable.

15. Prohibited Activities

Users shall not:

• Share OTPs or account credentials.
• Provide false identity or vehicle information.
• Attempt unauthorized access to the platform.
• Manipulate bookings or payments.
• Use the platform for unlawful purposes.
• Abuse or threaten parking staff.

Violation may result in immediate suspension or permanent termination of the account.

16. Suspension, Indemnity and Force Majeure

ParkVahan reserves the right to suspend or terminate any account without prior notice if it is involved in fraudulent activity, repeated policy violations, misuse of QR verification, abuse of platform features, or any activity that affects platform security or operations.

Users agree to indemnify and hold harmless ParkVahan, its directors, employees, partners, affiliates, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from misuse of the platform, violation of these Terms, or unlawful activities.

ParkVahan shall not be liable for any failure or delay in providing services due to events beyond its reasonable control, including natural disasters, government actions, strikes, internet outages, power failures, pandemics, or other force majeure events.

17. Third-Party Services

ParkVahan integrates with third-party services to provide essential platform features, including payment gateways, mapping and location services, notification and SMS/OTP providers, cloud infrastructure and data storage services, authentication services, and vehicle verification services where applicable. These third-party providers operate independently, and ParkVahan shall not be responsible for any interruptions, delays, inaccuracies, unavailability, or failures arising from their services.

18. Limitation of Liability

ParkVahan is a technology platform that facilitates parking management between Customers and Parking Owners. To the maximum extent permitted by law, ParkVahan shall not be liable for:

• Vehicle theft or damage.
• Loss of personal belongings.
• Delays caused by traffic or unforeseen events.
• Service interruptions due to technical failures.
• Acts or omissions of independent Parking Owners or their staff.

In no event shall ParkVahan's total liability exceed the amount paid by the user for the booking giving rise to the claim.

19. Privacy

Your use of ParkVahan is also governed by the ParkVahan Privacy Policy. By using the application, you consent to the collection, use, and processing of your information as described in the Privacy Policy.

ParkVahan may use anonymized and aggregated usage data for analytics, operational improvements, research, and other lawful business purposes.

20. Changes to These Terms

ParkVahan reserves the right to update or modify these Terms at any time. Updated Terms become effective immediately upon publication within the application. Continued use of the platform after such updates constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

The parties shall first attempt to resolve any dispute amicably. If the dispute remains unresolved, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. Subject to the arbitration proceedings, the competent courts where ParkVahan's registered office is located shall have exclusive jurisdiction.
